Burlison Secures Major Win as House Passes PERMIT Act
Judicial Review Timeline Clarity Act Included in Final Package
Washington, D.C. – Today, the House of Representatives passed the Promoting Efficient Review for Modern Infrastructure Today (PERMIT) Act, a major permitting reform package that includes Congressman Eric Burlison’s (MO-07) Judicial Review Timeline Clarity Act.
The Judicial Review Timeline Clarity Act establishes a firm 60-day deadline to file legal challenges against permits issued under Section 404 of the Clean Water Act. By preventing lawsuits from being filed months or even years after a project has already begun, the reform brings much-needed certainty to builders, local governments, energy producers, and agriculture.
“For too long, environmental activists have weaponized the courts to delay critical projects and drive up costs for our communities,” said Rep. Burlison. “My reform puts a stop to these last-minute lawsuits. With a clear 60-day deadline, we can finally give project sponsors the confidence to build, grow, and move America forward. I’m proud to deliver this win as part of the PERMIT Act.”
Section 404 permits are essential for infrastructure, pipelines, agriculture, mining, and construction projects that require placement of fill material into waters of the United States. The Judicial Review Timeline Clarity Act ensures that any legal challenges to those permits must be filed promptly, reducing costly delays and allowing projects to stay on schedule.
The PERMIT Act now moves to the Senate for further consideration.
